Terms of Service – MyMapData

These Terms of Service ("Terms") govern your use of the MyMapData website and services ("Service"). By accessing or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
1. Description of the Service
MyMapData provides a browser-based tool for uploading maps, georeferencing them, creating point data, and exporting geospatial data files.
The Service is provided on an "as-is" and "as-available" basis.
2. Payments and Purchases
When Payment Is Required
Payment is required at the time of exporting geospatial data from the Service.
Payment Processing
All payments are processed securely by Stripe. MyMapData does not store or have access to your full credit card information.
Failed or Declined Payments
If a payment is declined or fails for any reason:
- the transaction will not be completed, and
- you will not be able to download the requested data.

Refunds are handled on a case-by-case basis and are not guaranteed.
3. User Accounts and Access
MyMapData does not currently require users to create accounts. Access to paid features is managed through a browser-based session identifier.
You are responsible for maintaining the security of your device and browser environment. MyMapData is not responsible for loss of access resulting from cleared browser data or similar actions.
We reserve the right to suspend or restrict access to the Service for misuse, abuse, or illegal activity.
4. User-Generated Content
Ownership
You retain ownership of any maps, data, or content you upload to the Service.
License to Operate the Service
By uploading content, you grant MyMapData a limited, non-exclusive license to process and display that content solely for the purpose of providing the Service.
Responsibility
You are solely responsible for:
- ensuring you have the legal right to upload and process the content
- ensuring the content does not violate copyright, privacy, or other laws
MyMapData is not responsible for user-uploaded content.
5. Intellectual Property
All software, code, design, branding, logos, and site content provided by MyMapData are the intellectual property of MyMapData or its licensors.
You may not:
- copy, scrape, reverse engineer, or republish the Service
- use the MyMapData name or branding without permission
- use the Service for unauthorized commercial redistribution
Unauthorized use is strictly prohibited.
6. Service Availability and Limitations
We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.
MyMapData is not liable for:
- data loss
- lost business opportunities
- inaccuracies in exported data
- delays or interruptions in service
Use of the Service is at your own risk.
7. Limitation of Liability
To the maximum extent permitted by law, MyMapData shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the Service.
Our total liability shall not exceed the amount paid by you for the specific transaction giving rise to the claim.
8. Indemnification
You agree to indemnify and hold harmless MyMapData from any claims, damages, or liabilities arising from:
- your use of the Service
- your uploaded content
- your violation of these Terms or applicable laws
9. Governing Law and Jurisdiction
These Terms are governed by the laws of Canada, without regard to conflict of law principles.
Any legal disputes shall be resolved exclusively in the courts located in Ontario, Canada.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
